PRESS RELEASE REPORT ON THE NOMINATION OF MEMBERS OF THE CONSTITUENT ASSEMBLY OF THE CONSTITUTION

INTRODUCTION

1. Appointment of Members of the Constituent Assembly dominated by the Constitutional Reform Act , Cap , 83 ( The Constitutional Review Act, Cap 83) . This law establishes the authority of the appointment , conditions, procedures, criteria and other factors all need to be in the selection of the members of the Constituent Assembly . In accordance with Section 22 ( 2A ) and ( 2B ) of these criteria include age , gender , experience, qualifications and where they're from member concerned.

2 . This law stipulates three types of Members of the Constituent Assembly as follows : -

( i ) All Members of the Parliament of the United Republic;

( ii ) Members of the Zanzibar House of Representatives , and

( iii ) Members 201 in accordance with Sect. 22 ( 1c ) of the Constitutional Reform Act which shows 10 different groups involved.

3. These groups are as follows : -

( i ) NGOs ( 20)

( ii ) Religious Institutions ( 20)

( iii ) All parties that have permanent registration Politics ( 42 ) ;

( iv ) Institute of Education ( 20) ;

( v ) People with Disabilities ( 20) ;

( vi ) Trade Unions ( 19 ) ;

( vii ) Organizations representing Breeders ( 10 ) ;

( viii ) Organizations representing fishermen ( 10 ) ;

( ix ) Agricultural Unions ( 20 ) and

( x ) Groups of people with similar goals ( 20) .

4. The selection process was started to provide a Notice of Invitation in the Gazette , Government Notice 443 dated December 13, 2013 . The announcement was made in Kiswahili and English in order to invite them into groups mentioned legal submit proposed names for selection in the Constituent Assembly laMaalum . In addition, the announcement of the invitation also announced in the newspapers that are read below. Among other things Announcement of Invitation announced time limit of institutions and groups to submit proposals for the names of members that are dated 02/01/2014 .

5. These proposals were to be submitted to the Chief Secretary to the Government of the United Republic of Tanzania to the mainland and in Zanzibar , recommendations were to be submitted to the Chief Secretary to the Government of Zanzibar .

6 . Following the invitation, 554 institutions from Tanzania Mainland and Zanzibar submitted, 178 from their recommendations . These recommendations included 2,762 names on the mainland and in Zanzibar proposals that included 874 people . Thus, institutions and groups recommended the 3,636 names . However, and contrary to law, 118 people were ingratiate themselves to make a number of names proposed to be 3754 .

8. Constitutional Reform Act establishes conditions considered in the selection of 201 members of the Constituent Assembly of the Constitution. These conditions include at least one-third members come from Zanzibar and two thirds from the mainland . For this reason , the 201 members , 67 members are from Zanzibar with 134 delegates will come from the mainland . In addition , the proportion of women members and men should be half and half . Despite this, these members represent a chapter of the citizens of Tanzania for the support of political parties , religions , ages, and places they came from . In these circumstances , the process of getting 201 members was not easy at all. Response categories was much greater than the space available .

9 . As I mentioned earlier, the proposals from Tanzania mainland was 2,880 at the position of members is 134. In Zanzibar , the names suggested were 874 compared to 67 the number of members who must be appointed . For additional information about the quantity of proposals, is that if you take the non- governmental institutions in the mainland for the proposed 1,203 people , while the space that was supposed to be filled is only 13. In terms Zanzibar , non-governmental organizations have suggested names were 444 compared to only 7 positions that were supposed to be filled from these institutions .

MEMBERS OF PARLIAMENT OF THE CONSTITUTION

10 . President of the United Republic of Tanzania in collaboration with the President of Zanzibar and Chairman of the Council of Zanzibar Mpainduzi have completed selection of 201 members . Before mentioning the list of members appointed , I would like to clarify the following issues:

( a) The selection was based on the participation of people of all ages , even teenagers , adults and the elderly. For this purpose , the young members aged between 22-35 years , is 35 members . Members aged , ie 36-64 years , is 145 , and the older members , ie aged 65 and keep it 21 .

( b ) The law mandates a balanced ajumbe for women and men. This limezingatiwa appropriately , and in this list are 100 members women and 101 men . Since it will not be half a man , and therefore the number of members is 101 men .

( c ) Representatives of political parties which requires each party with full registration should have two members has been implemented. Given that there are political parties that have permanent registration 21, a total of 42 members were elected in that two members are nominated from each party.

After such an introduction, the following is the list of 201 members of the Constituent Assembly of the Constitution were fortunate appointment :

TAARIFA KWA VYOMBO VYA HABARI KUHUSU UTEUZI WA WAJUMBE WA BUNGE MAALUM LA KATIBA

UTANGULIZI
1. Uteuzi wa Wajumbe wa Bunge la Katiba Unatawaliwa na Sheria ya Mabadiliko ya Katiba, Sura, 83 (The Constitutional Review Act, Cap 83). Sheria hii inaweka mamlaka ya uteuzi, masharti, taratibu, vigezo na mambo mengine yote yanayopaswa kuzingatiwa katika uteuzi wa Wajumbe wa Bunge la Katiba. Kwa mujibu wa Kifungu cha 22 (2A) na (2B) vigezo hivi vinajumuisha umri, jinsia, uzoefu, sifa na mahali anapotoka mjumbe husika.

2. Sheria hii inatamka aina tatu za Wajumbe wa Bunge la Katiba kama ifuatavyo:-
(i) Wabunge wote wa Bunge la Jamhuri ya Muungano;
(ii) Wajumbe wa Baraza la Wawakilishi la Zanzibar; na
(iii) Wajumbe 201 kwa mujibu wa Kifungu Na. 22(1c) cha Sheria ya Mabadiliko ya Katiba ambayo inaonyesha makundi mbalimbali 10 yanayohusika.

3. Makundi hayo ni kama ifuatavyo:-

(i) Taasisi zisizokuwa za Kiserikali (20)
(ii) Taasisi za Kidini (20)
(iii) Vyama vyote vya Siasa vyenye Usajili wa Kudumu (42);
(iv) Taasisi za Elimu (20);
(v) Watu wenye Ulemavu (20);
(vi) Vyama vya Wafanyakazi (19);
(vii) Vyama vinavyowakilisha Wafugaji (10);
(viii) Vyama vinavyowakilisha wavuvi (10);
(ix) Vyama vya Wakulima (20); na
(x) Vikundi vya Watu wenye Malengo yanayofanana (20).

4. Mchakato wa uteuzi ulianza kwa kutoa Tangazo la Mwaliko katika Gazeti la Serikali, Tangazo la Serikali Na 443 la tarehe 13 Desemba, 2013. Tangazo hilo lilitolewa kwa lugha ya Kiswahili na Kiingereza ili kuyaalika makundi yaliyotajwa kisheria kuwasilisha mapendekezo ya majina kwa ajili ya uteuzi katika Bunge laMaalum la Katiba. Aidha, Tangazo hilo la mwaliko lilitangazwa pia katika magazeti mbalimbali yanayosomwa hapa nchini. Pamoja na mambo mengine Tangazo la Mwaliko lilitamka ukomo wa muda wa Taasisi na Makundi kuwasilisha mapendekezo ya majina ya wajumbe kuwa ni tarehe 02/01/2014.
5. Mapendekezo hayo yalitakiwa kuwasilishwa kwa Katibu Mkuu Kiongozi wa Serikali ya Jamhuri ya Muungano wa Tanzania kwa upande wa Tanzania Bara na kwa upande wa Zanzibar, mapendekezo yalitakiwa kuwasilishwa kwa Katibu Mkuu Kiongozi wa Serikali ya Mapinduzi Zanzibar.

6. Kufuatia mwaliko huo, taasisi 554 kutoka Tanzania Bara na 178 kutoka Zanzibar ziliwasilisha mapendekezo yao. Mapendekezo hayo yalijumuisha majina 2,762 kwa upande wa Tanzania Bara na kwa upande wa Zanzibar mapendekezo hayo yalihusisha watu 874. Hivyo basi, taasisi na makundi mbalimbali yalipendekeza jumla ya majina 3,636. Lakini, na kinyume na Sheria, watu 118 walijipendekeza wenyewe na kufanya idadi ya majina yaliyopendekezwa kuwa 3,754.

7. Mchanganuo wa idadi ya watu walipendekezwa katika makundi mbalimbali ni kama ifuatavyo:

8. Sheria ya Mabadiliko ya Katiba imeweka masharti ya kuzingatiwa katika uteuzi wa wajumbe 201 wa Bunge la Maalum la Katiba. Masharti hayo ni pamoja na wajumbe wasiopungua theluthi moja wanatakiwa kutoka Zanzibar na theluthi mbili kutoka Tanzania Bara. Kwa sababu hiyo, katika wajumbe 201, wajumbe 67 watatoka Zanzibar na wajumbe 134 watatoka Tanzania Bara. Aidha, mgawanyo wa wajumbe wanawake na wanaume unatakiwa uwe nusu kwa nusu. Pamoja na hayo, wajumbe hao wawakilishe sura ya wananchi wa Tanzania kwa ufuasi wa vyama vya siasa, dini, umri, na maeneo wanayotoka. Katika mazingira haya, zoezi la kupata wajumbe 201 halikuwa rahisi hata kidogo. Mwitikio wa makundi ulikuwa mkubwa sana ikilinganishwa na nafasi zilizopo.
9. Kama nilivyoeleza hapo awali, mapendekezo kutoka Tanzania Bara yalikuwa 2,880 wakati nafasi za wajumbe ni 134. Kwa upande wa Zanzibar, majina yaliyopendekezwa yalikuwa 874 ikilinganishwa na idadi ya wajumbe 67 wanaotakiwa kuteuliwa. Kwa nyongeza ya maelezo kuhusu uwingi wa mapendekezo, ni kwamba ukichukua taasisi zisizo za kiserikali kwa upande wa Tanzania Bara walipendekezwa watu 1,203,wakati nafasi zilizokuwa zinatakiwa kujazwa ni 13 tu. Kwa upande Zanzibar, taasisi zisizokuwa za kiserikali zilikuwa zimependekeza majina 444 ikilinganishwa na nafasi 7 tu zilizokuwa zinatakiwa kujazwa kutokana na taasisi hizi.

WAJUMBE WA BUNGE LA KATIBA
10. Rais wa Jamhuri wa Muungano wa Tanzania wakishirikiana na Rais wa Zanzibar na Mwenyekiti wa Baraza la Mpainduzi Zanzibar wamekamilisha uteuzi wa wajumbe 201. Kabla ya kutaja orodha ya wajumbe walioteuliwa, napenda kufafanua mambo yafuatayo:
(a) Uteuzi umezingatia ushiriki wa watu wa rika zote, yaani vijana, watu wazima na wazee. Kwa ajili hiyo, wajumbe vijana yaani wenye umri wa kati miaka 22-35, ni wajumbe 35. Wajumbe wenye umri wa kati, yaani miaka 36-64, ni 145; na wajumbe wazee, yaani wenye umri wa miaka 65 na kuendelea ni 21.
(b) Sheria inataka kuwepo na uwiano sawa kwa ajumbe wanawake na wanaume. Jambo hili limezingatiwa ipasavyo, na katika orodha hii wajumbe wanawake ni 100 na wanaume 101. Kwa vile, haiwezekani kuwa na nusu mtu, ndiyo maana idadi ya wajumbe wanaume ni 101.
(c) Uwakilishi wa vyama vya siasa ambao unahitaji kila chama chenye usajili wa kudumu kiwe na wajumbe wawili umezingatiwa. Kwa kuwa kuna vyama vya siasa vyenye usajili wa kudumu 21, jumla ya wajumbe 42 wamechaguliwa kwa maana ya kuwa wajumbe wawili wameteuliwa kutoka katika kila chama.
Baada ya maelezo hayo ya utangulizi, ifuatayo ndiyo orodha ya wajumbe 201 wa Bunge Maalum la Katiba waliobahatika kuteuliwa:
